Insurance Fraud Mineral Wells, TX Man Senteced

Texas Mutual Insurance Company reported that a Travis County district court sentenced Michael Shane Schmidt of Mineral Wells, Texas, on workers’ compensation fraud-related charges.  The court sentenced Schmidt to one year of deferred adjudication and ordered him to pay $2,649 in restitution to Texas Mutual.

Schmidt reported a job-related injury while working as a truck driver for E.L. Farmer and Company in Odessa, Texas.  He claimed he was unable to work as a result of the injury, and Texas Mutual began paying income benefits to him.

http://liarcatchers.com/insurance_fraud.html

Texas Mutual uncovered evidence that Schmidt was working as a truck driver for another company while receiving income benefits due to his alleged disability.

Investigators call this type of scam double-dipping because the claimant collects benefits for being too injured to work when he or she is, in fact, gainfully employed.  Texas law requires claimants to contact their workers’ comp carrier when they return to work.  Left unchecked, double-dipping and other workers’ comp fraud can lead to higher premiums for all Texas employers.

Missing Person Body of UT Man Found

Dee Ray Humphries, 83, of Millard County, UT was reported missing July 13, 2013 and was found dead in Churchill County on Aug. 17.

He was reported to have been driving a red Toyota Corolla and was possibly en route to the Stockton, CA area. On August 16th, around 11:30 AM the Churchill County Sheriff’s Office received a report of a suspicious vehicle with the driver’s door open and cobwebs around it. The Sheriff’s Office responded approximately 50 miles east of Fallon and located the vehicle on a dirt road 3.3 miles south of state Route 722 between Hwy. 50 and the Eastgate community. The vehicle was registered to Humphries. Evidence indicated the vehicle, which was still in drive, had run out of gas and Humphries had activated the emergency flashers, exited the vehicle and walked away. Evidence at the scene also indicated the vehicle had been at that location for an extended period of time.

Churchill County Search and Rescue responded and a ground and aircraft search was conducted in the area on the 16th and 17th. Humphries’s body was located a short distance from the vehicle at 8am on the 17th.

There is no evidence of foul play. Humphries, according to the missing person bulletin, suffered from dementia.

Wrongful Death Breathitt County Woman Seeks Answers in Father’s Death

Who shot her father? A Breathitt county woman is asking that question as she finalizes funeral arrangements for 46-year-old Tommy Lee Smith.

Kentucky State Police confirmed Monday Smith had been shot to death, but so far, no suspects have been arrested.

The Breathitt County Coroner said Smith’s body was found in a camper in Highway 1110 Saturday morning in Altro with one gunshot to the head.

http://liarcatchers.com/wrongful_death.html

Three days after her father’s death, Mildred Johnson says she won’t have any closure until someone is behind bars.

“Today is my mom’s birthday and it is hard to set up there with my mom when I have been at this place for my father,” Johnson said.

Instead of celebrating,Johnson finalized the funeral arrangements for her father.

Police believe someone with a grudge against Smith might have been the one who pulled the trigger. But for his family, those words are hard for the family to swallow.

“Every time they tell me that I think it is impossible. I don’t see how anyone could be enemies with my dad. People have said it might have been stuff he was involved in, but even if he was involved with something in the past he doesn’t deserve to be murdered, my dad was a good person,” Johnson said.

With no suspects and so many questions left unanswered, it is hard for his daughter to come to terms with his death.

“My littlest one looks just like him and people tell me I look like him, so them growing, me knowing they lost someone who would always be there for them is going to be very hard,” Johnson said.

Missing Person Family Celebrates Missing Madison County Teen’s Birthday

It’s been nearly two months since a Madison County teen disappeared. On Monday her absence was especially hard as loved ones celebrated her 19th birthday.

Dozens of family members gathered on Monday and sent messages into the air, all in hopes of bringing Brookelyn Farthing back home.

“We want Brooke home, we love her,” said Brookelyn’s grandmother, Bonnie Foster.

Since Brookelyn went missing everyday, every hour, every minute has been a struggle for family. However, perhaps no moment was as difficult as her birthday.

“Happy birthday, you are loved by many,” said Brookelyn’s stepfather, Randall Walker.

Brookelyn’s family came together for her golden birthday. Since Brookelyn’s wasn’t there, they let off pink and yellow balloons symbolizing her favorite color, her golden birthday, and her memory. Each balloon was specially made by family who wrote a note on the side.

“Their heart, what they felt in their heart for Brooke. Some wrote to god and asked to bring Brooke home others wrote a message straight to Brooke,” said Walker.

However they were written, whomever they were from, the words echoed a single message. “We want you home Brooke. We miss you, we love you, there’s nothing in this world to keep you away from us Brooke,” said Walker.

Her family refuses to stop searching, and asks the community to do the same. “We do not want this to be swept under the rug and let go. This isn’t just my granddaughter, it could be yours,” said Foster.

Brookelyn was last seen on June 22nd at a home in Berea. The night she went missing, the house was destroyed by a fire.

“Someone out there knows something, why they have not come forward? I don’t know why,” said Walker.

Now family is looking for the truth, for some sort of closure. As each heart wrenching moment passes, they remember why they are fighting and never forget the girl they miss so much.

“Brooke is never going to be erased, Brooke is here. She’s in our hearts and we will always hold hope out that Brooke will come home,” said Walker.

Brookelyn’s family has organized a bass fishing tournament fundraiser on august 24th at Lake Linville, from 7 a.m. to 2 p.m. Registration will be held from 5 a.m. to 7 a.m. that morning. For more information contact John Crane at 859-985-9273.

The money from the last fundraiser will be used to put up five billboards for Brookelyn across Madison County. The family is also working on making a reward.

If you have any information on where Brookelyn is, or what happened to her, you are asked to call Kentucky State Police.

Wrongful Death Body of Missing Gwinnett Man Found in Atlanta

Gwinnett police took over a homicide investigation Monday after a body found in Atlanta was linked to a missing person case in their county.

Atlanta officers responded to a call Sunday around 3:45 p.m. and found a man’s partially dressed body on the embankment of sunken land near the intersection of Proctor and Tazor streets, police spokeswoman Officer Kim Jones said. The preliminary investigation indicated that the man had been shot several times and his body was brought to that location, she said.

http://liarcatchers.com/wrongful_death.html

The body found matches the circumstances of a Gwinnett case, Cpl. Jake Smith with Gwinnett police said.

Saturday night, Gwinnett authorities responded to a suspicious activity call in the 6400 block of Buford Highway near Doraville, Smith said. The caller reported hearing screams and gunshots. Officers found blood and a spent shell casing, but no victim.

Detectives believe the victim is a man who was reported missing Saturday, but they are not yet releasing his name, Smith said. The missing man’s vehicle was located near the crime scene.

Gwinnett detectives and the medical examiner’s office are working to confirm the identity of the deceased.

Missing Person Remain Found in Car Believed to be of Man Missing 10 Years

Divers have recovered the skull, an arm bone and identification of the person whose remains were found in a submerged car in the Detroit River on Thursday afternoon.

Police Chief Daniel Grant said divers from the Downriver Underwater Search and Recovery Team returned Friday morning to the murky waters behind the Wyandotte Boat Club. A 1999 Mercury Sable had been pulled out of this location Thursday after being discovered by a recreational diver a week earlier.

http://liarcatchers.com/missing_persons_investigations.html

Grant said the skull is important because it might help investigators determine a cause of death and provide positive identification through dental records.

The remains are believed to be those of a Lincoln Park man missing for almost 10 years. Although not official, all signs point to 30-year-old Thomas Daniel Lange, who was last seen on the night of Dec. 30, 2003, in Allen Park.

Grant said a Detroit man doing recreational scuba diving in an area adjacent to BASF Waterfront Park reported the discovery of the car, resting upside-down in 25 feet of water, Aug. 9. He removed the license plate and brought it to the Wyandotte Police Department. Police could not find any record of the plate in their computer network, most likely because of the long period of time that had elapsed since it last was registered with the state.

“It could have been a dumped car or insurance fraud,” Grant said. “I called the dive team and they said they would look for it during their regular training on Thursday.”

They arrived on the river at about 1 p.m. and, after several minutes of searching the areas, they located the submerged car and were able to attach a cable to its underside. Police officers and firefighters dragged the vehicle from the river bottom onto the shoreline with a tow truck.

“Officers were able to remove the vehicle windows and it was determined that a badly decomposed body was located inside the vehicle,” Grant said. “Further examination of the body revealed that it was missing both hands and the entire head. Both feet also were detached, with one being located next to the shoreline in the water and one inside the vehicle on the rear floorboard.”

Police learned the vehicle and its owner, Lange, were reported missing Dec. 30, 2003, in a report filed with the Lincoln Park Police Department.

“At the time of recovery, the body size does fit the known description of Mr. Lange and the clothing also appears to be similar to what he was last observed wearing,” Grant said.

The Downriver Search and Recovery Team re-entered the river Friday morning to conduct a more thorough search of the area and found identification belonging to Lange, some additional bone sections and a head/skull at 11:30 a.m.

Grant said an autopsy was conducted Friday on the remains found in the vehicle and the additional body parts just discovered were forwarded to the Wayne County Medical Examiner’s office. He said the investigating agencies will not be certain of the identity of the vehicle’s occupant until investigators are able to complete a review of dental records or analysis of DNA.

Grant said his department is working with the Lincoln Park Police Department in the investigation.

When asked how it is possible for a vehicle to have been submerged in a well-used portion of the river for almost a decade without being detected, Grant said the dark and cloudy waters of the river help to conceal even a large object such as a car.

Grant said the dive team has conducted training exercises in that area in the past, but unless a diver gets within two feet of it, the car could not be seen. He added that sediment and zebra mussels covering the car helped keep it concealed until the recreational diver came across it.

It’s not known exactly where the car entered the water, since the river current may have pushed it for a short distance. Unlike Bishop Park, which has barriers to keep people from falling in the river, the area behind the Boat Club has open ramps where boats are launched, which is where the car probably went in.

A flier posted shortly after Lange’s disappearance states that he had just gotten off work at Tullio’s La Riviera restaurant in Allen Park and walked across Allen Road to the Wheat & Rye Steak House. He was never seen again.

Friends and family immediately suspected foul play, saying he would never leave his son. Lange reportedly was the father of a baby at the time he disappeared.

Police said they found a stroller in the trunk of the car, as well as a baby seat in the passenger compartment.
