Pedophile Tracking Alabama Man Arrested

Police in Shelby County say the husband of an in-home daycare owner has been arrested on child sex abuse charges.

Alabaster Police Chief Curtis Rigney said Wednesday that two children told their parents Eligio Rios-Martinez molested them at the daycare his wife runs out of their home.

Police say 57-year-old Rios-Martinez is being held in the Shelby County Jail on $400,000 bond. It’s unclear if he has an attorney.

Police are working with the Alabama Department of Human Resources to determine if there are any additional victims.

Alabaster is about 25 miles south of Birmingham.

Missing Person Kansas City Man Found in Chicago

Police say a Kansas City, Mo., man with dementia who went missing in the Chicago suburbs has been reunited with his family.

Authorities say 79-year-old Robert Tribbitt was reunited with his family Friday.

Police say he went missing in Addison on Thursday. Addison Deputy Chief Mike Simo tells the Daily Herald that Tribbitt had no apparent injuries but was taken to a hospital for observation.

Tribbitt was in suburban Chicago with a church group. Simo says police “looked for him all night.”

Accident Reconstruction Knox County Man Arrested After DUI Crash

A Knox County man was arrested Thursday night following a DUI accident that injured three, including two children.

Tony Broughton, 44, was a passenger in a truck involved in the alleged DUI at about 11 p.m. at Daniel Boone Drive and 25 E. Police say Broughton was also intoxicated. His two sons, both under 12, were in the bed of the truck when the alleged DUI driver wrecked.

Everyone but the driver was taken to the hospital.

Police say Broughton left the scene of the accident and was located down the road on 25 E.

The driver of the vehicle was also cited with DUI and wanton endangerment.

Pedophile Tracking Middle School Teacher Charged with Sodomy

A seventh-grade teacher at Cecil Gray Middle School in Groveland, who also coaches swimming at South Lake High School and at the National Training Center in Clermont, has been charged with sodomy of a child and three other sex crimes in Kentucky, Hopkins County Jail officials said.

“The school district is currently moving to terminate his contract,” Chris Patton, public information officer for Lake County Schools, said of Samuel Yardley Hann, 24. “He has been employed by the school district since March. He was on a probationary period.”

Hann is a Kentucky native who was hired in 2011 as a teacher at Browning Springs Middle School in Madisonville, the county seat of Hopkins County, a coal mining region in the western corner of the state. He also served as the middle school’s head football coach and as the head swim coach at Hopkins County Central High School for the past two years, according to Channel 14 News in Evansville, Ind.

Details of Hann’s arrest were unavailable but jail officials said he was booked into the jail on Monday and released Tuesday on $5,000 bond. The other charges were use of a minor under 16 in a sexual performance, possession of matter portraying sexual performance by a minor and possession of an electronic device to procure a minor.

This spring, Hann, also known as “Coach Sammy,” moved to Florida and was hired as a seventh-grade math teacher at Cecil Gray Middle. His profile page there said he was named South Lake’s head boys’ swim coach, while South Lake’s website just lists him as an instructor.

However, the NTC website lists Hann as an assistant volunteer coach there who “recently accepted the head boys’ swim coach position at South Lake High School.” At the NTC, Hann is helping the facility develop its “competitive age group” program, its website states.

Missing Person Search for Man in Hillsdale Lake in KS

The search for a man who disappeared on the Fourth of July while swimming in a Miami County lake resumed Friday morning.

The 29-year-old resident of Kansas City, Kan., was in the water near a swimming beach at Hillsdale Lake when he was last seen Thursday, according to the Miami County Sheriff’s Office.

Searchers suspended their efforts around midnight, and resumed again at first light Friday, according to the sheriff’s office.

Hillsdale Lake is about 20 miles southwest of Olathe.

Accident Reconstruction 5 Hurt in Bourbon County Accident

Five people suffered injuries in a crash along Russell Cave Road in Bourbon County Friday morning.

Police say a pickup truck traveling east along Hawkins Cummins Road slid through a stop sign at the intersection of Russell Cave and T-boned a van. The impact pushed the van into a telephone pole and the vehicle then slid into a ditch. The pickup rolled several times.

Private Investigator Police Search for Man who Robbed Hairdresser

The search continues for a man who did not leave a tip but instead took money after a haircut in Montgomery county.

It happened around 10 a.m. Wednesday morning at Country Charm Hair-Styles.

Police say a man got a hair cut, then held the hair-dresser at knife point before taking off in her 2005 Buick Lesabre.

Wrongful Death New Evidence in Case of Man Accused of Killing Parents

Boone County man wants his murder case dismissed due to some new DNA evidence in the case.

Michael Moore is charged with gunning down his own parents, back in 2009.

His defense team says they had an independent lab look at the alleged murder weapon and that’s when they found a second person’s DNA.

Fraud Investigation Father and Son Plead Guilty in St. Louis Funeral Scam

The former owner of a Clayton company that federal prosecutors have accused of orchestrating a pre-arranged funeral scam that could cost as much as $600 million has pleaded guilty to fraud and other charges.

James “Doug” Cassity, 67, of Clayton, who bought National Prearranged Services Inc. in 1979, pleaded guilty in U.S. District Court here Wednesday afternoon, hours after his son, Brent Cassity, 46, of Clayton, pleaded guilty to a similar set of charges.

Assistant U.S. Attorney Charles Birmingham called National Prearranged Services a “Ponzi-like scheme” and said that for more than 16 years, the company and affiliated insurance companies broke promises to customers and state regulators and used money for the personal enrichment of company officers and others.

National Prearranged Services sold pre-arranged funeral policies, which promised customers that they could prepay for their funerals, preventing their heirs from being burdened by high funeral costs. The money was supposed to be held in trust or in an insurance policy that would cover the eventual funeral costs. Birmingham said National Prearranged Services regularly withdrew millions of dollars from the trust accounts, took unauthorized loans on customers’ insurance policies, and used the money to pay the business’ expenses. They also lied to regulators about their practices.

Employees of one affiliated insurance company, Lincoln Memorial Life Insurance Company, were told to alter documents to cover up the diversion of money. In one example, a woman identified only by initials paid $10,242 upfront, but Lincoln Memorial employees were told to “white out” that information, and instead she was made to look as if she planned to pay monthly, and her initial deposit was a correspondingly small fraction of the real amount.

In 2007, when Ohio regulators asked the company about their business practices, National Prearranged Services told Lincoln Memorial to remove all the loans on Ohio customer accounts and move them to customers in other states to hide those loans.

The company stopped selling funeral policies in 2008 after Missouri and other states began scrutinizing its business practices, and Texas forced the company’s liquidation later that year.

Prosecutors have said that the scam affected up to 150,000 customers who paid up to $10,000. The scheme could eventually cost $450 million to $600 million as customers die and the costs for funerals pile up. The funeral costs will be absorbed by state guarantee associations.

‘I’VE TAKEN RESPONSIBILITY’

Doug Cassity pleaded guilty to two counts of wire fraud, one count of bank fraud, one count of mail fraud, one count of money laundering and one count of misappropriation of an insurance premium. Brent Cassity pleaded guilty to mail fraud, wire fraud, money laundering and willfully permitting a felon to exercise significant control over an insurance company. The final charge refers to his father, a convicted felon.

The plea agreements have been sealed, as three co-defendants await trial. U.S. Attorney Richard Callahan declined to comment after the pleas, other than to say that the remaining men are presumed innocent.

Brent Cassity appeared reluctant to take the plea deal, pausing several times when asked by U.S. District Judge Jean Hamilton whether he agreed with what was contained in the plea deal.

Under the same questioning, Doug Cassity equivocated, responding, “I’ve taken responsibility,” when asked if he agreed. Later, he said, “By signing this document, I agree.”

After another hedge, Hamilton told him, “Just answer the question.’

Cassity then said, “Yes.”

Doug Cassity’s deal will earn him 115 months or less in federal prison. Brent Cassity is expected to serve five years or less. Both are scheduled to be sentenced Nov. 7.

Sharon Nekol Province, 69, of Ballwin, pleaded guilty last month to six counts of mail fraud, wire fraud and misappropriation of insurance premiums in a deal that should net her three years or less in prison.

Province was listed as vice president of a series of family trusts and businesses and performed notary work, hired and fired staff and wrote checks and made wire transfers with approval of bosses.

Assistant U.S. Attorney Steven Muchnick said in court at the time of the plea that Province “deliberately closed her eyes to the fraudulent scheme.”

The company’s former lawyer, Howard A. Wittner, 76, of Chesterfield, former CFO Randall K. Sutton, 67, of Chesterfield, and former investment adviser David R. Wulf, 60, of St. Louis County, still face charges.

They have been offered deals that would mean six years or less, and could face up to life in prison if they go to trial. But the deals expired Wednesday. A Post-Dispatch reporter spotted lawyers for one of those defendants heading up in an elevator to the U.S. Attorney’s office just before 4:30 p.m.
