Private Detective: Alleged Uber Attacker Sues Driver For $5 Million

The former Kentucky man accused of attacking a California Uber driver in November is suing the driver for millions of dollars.

Days after the video went viral with more than 2 million views, Benjamin Golden, spoke about the incident.

“It’s not me in the video it’s not me and it was hard to watch.”Golden said. “I’m ashamed and what’s taken me so long to talk to anybody is because I’ve been scared.”

But just two months after that night, Golden is suing the Uber driver, Edward Caban,  for $5 million.

“I lost my job I don’t have a lot of resources behind me,” Golden said.

Golden was an executive for Taco Bell. Before that, he worked in the Public Relations department for YUM brands in Louisville and acquaintances said he often traveled to Lexington.

Golden was fired from his new job in California soon after the video went public.

That’s only part of the reason Golden is suing Caban. The other reason, Golden’s lawyer claims the video was recorded illegally and that his client didn’t know the camera was on.

In a court hearing, Golden said that he denies causing any damage to the driver. saying Caban is responsible for any injuries that night which is contrary to what Caban remembers.

“He was grabbing my head and was trying to smash it against the window,” said Caban. “He was very aggressive, he was swearing at me, he was fading in and out of consciousness.”

As for the video that made national headlines, Golden’s lawyer says she will try to have it thrown out of his criminal case saying it was recorded illegally.

According to the California penal code, a person cannot record a conversation without consent.

However, the driver’s attorney believes that only applies to audio recording, not video recording
