Wrongful Death Three Man Indicted in Connection to Shooting Death of Trinity Gay

Three men have been indicted in connection to the death of 15-year-old Trinity Gay outside of a Lexington restaurant.

The three suspects were indicted this week, after being previously identified and charged as part of the ongoing investigation into the fatal shooting that occurred Sunday, October 16 outside the Cook Out restaurant.

Chazerae M. Taylor was indicted on four counts of wanton endangerment and one count of wanton murder for his role in creating the environment that ultimately led to the death of 15-year-old Trinity Gay.

Lamonte Williams was indicted on four counts of wanton endangerment and D’Markeo Taylor was indicted on one count of wanton endangerment.

The indictments were served Thursday afternoon. A fourth individual in this case, Dvonta Middlebrooks, has been lodged in the Fayette County Detention Center since his arrest on October 16 for wanton endangerment.

All four were only initially charged with wanton endangerment.

15-year-old Gay was a student athlete at Lafayette High School.

Identity Theft Two Arrested in Boyle County on Identity Theft, Drug Charges

Police in Boyle County arrested two people accused of trafficking drugs and stealing the identities of multiple people.

The Boyle County Sheriff’s Department arrested Jordan Rousey and Michael Daniel on Tuesday.

Rousey and Daniel were found inside a truck that was wanted out of Harrodsburg. Deputies say both had multiple active warrants when they were pulled over.

Deputies found eight grams of crystal meth, marijuana, pills, cash and other paraphernalia inside the truck.

They also found multiple drivers’ licenses, credit cards, social security cards and checkbooks that belonged to other people.

Rousey is charged with multiple counts of drug trafficking.

Rousey and Daniel are charged with multiple counts of theft of identity and criminal possession of a forged instrument.

Rousey and Daniel are both lodged in the Boyle County Detention Center.

Insurance Fraud NJ Man Charged in $500k Life Insurance Fraud

Attorney General Christopher S. Porrino and the Office of the Insurance Fraud Prosecutor (OIFP) announced that a Bergen County man has been charged in an insurance fraud scheme in which he allegedly used the death of an acquaintance to try to cash in a $500,000 insurance policy he had fraudulently obtained in the name of another man.

Donald Blake, 45, of Maywood, was indicted on second-degree attempted theft by deception and third-degree counts of conspiracy and insurance fraud in the alleged scam that began with the death of a man who apparently died in his sleep at a home in Elizabeth in November 2013.

According to prosecutors, the dead man, who was an acquaintance of Blake, was deliberately misidentified to authorities as “John White,” who purportedly lived with his “son-in-law” Blake and had died while visiting relatives. Four years earlier, Blake had taken out a $500,000 life insurance policy with Household Life Insurance in the name of his father-in-law John White. Blake attempted to cash in that policy upon the death of the man in Elizabeth, prosecutors said.

In reality, Blake had no father-in-law named John White, and the John White whose personal information was listed on the Household Life Insurance policy is alive in New York and has no apparent connection to Blake, prosecutors said.

“We are alleging that this was an elaborate scheme concocted to steal half a million dollars from an insurance company,” said Attorney General Porrino. “This defendant allegedly took out a sham life insurance policy in the name of a stranger, then spent years just waiting for someone to die so he could cash it in.”

“When you strip away the macabre details of this alleged con, it’s a classic example of the kind of fraud that undermines the integrity of the insurance system,” said Christopher Iu, Acting Insurance Fraud Prosecutor. “When dishonest people lie and cheat to illegally collect payouts, it drives up costs for everyone.”

The indictment is merely an accusation and the defendants are presumed innocent until proven guilty. Second-degree crimes carry a sentence of five to 10 years in state prison and a criminal fine of up to $150,000; third-degree crimes carry a sentence of three to five years in state prison and a criminal fine of up to $15,000.

Deputy Attorney General Michael Clore presented the case to the grand jury. Detectives Justin Callahan, Ronald Allen, Little Wright, and Investigator Marwa Kashef coordinated the investigation.

Insurance Fraud Castle Hayne, NC Man Accused

A Castle Hayne man is charged with insurance fraud and attempting to obtain property by false pretense after a wreck last month.

Department of Insurance investigators say Scottie Sharay Porter, 41, lied about the circumstances surrounding an accident that happened November 10, in order to change his insurance company’s coverage.

According to the Wilmington police report, Porter was driving west on Marstellar Street when he lost control of his vehicle, struck a curb, and spun on the sidewalk/curb before coming to a stop. The front, passenger side and rear of the vehicle was damaged.

Investigators say Porter denied his vehicle was damaged on an application after the accident happened.

Porter was arrested Monday and released on $10,000 bond.

Private Detective: Man Arrested in Connection With Stolen Trailer

A man was arrested Thursday in London in connection with a trailer that was reported stolen earlier in the week.

Deputies say that the 12-foot enclosed V-nose trailer was reported stolen from a business parking lot off US 25 on Monday.

The trailer was recovered by Sgt. Robbie Grimes off Arthur Ridge Road on Wednesday around 3:00 p.m. Deputies say it was parked at a residence there.

Following an investigation, deputies arrested Joshua Terry, 34, on Thursday. He was charged with theft by unlawful taking $500 or more -under $10,000 , and burglary, third-degree.

They say that the trailer was full of camping equipment, a grill, RV holding tanks, a fire pit, and smokers. Most of those items have been recovered.

Other arrests are possible.

Private Detective: Family Identifies Body Found

A death investigation is underway in Magoffin County after a woman’s body was found in a creek in Royalton.

The body was found on Route 7 near Royalton Food Mart.

Relatives say that the woman found is Misty Joseph, a mother of four.

Joseph’s cousin says she left home at 3:00 a.m. but they never heard back from her.

She was found only a couple hundred feet from her home.

“We were shocked. We literally just ran to where she was this morning from here,” said Nicole Joseph, Misty’s cousin.

In February 2011, LEX18 met with Misty after her brother, Jerry Rowe Jr., was reported missing. She talked about the pain of not knowing where he was, or what happened to him.

Now, Misty’s loved ones are left asking that again.

“It’s very heartbreaking, especially for her father, to be going through this again with his daughter,” said Nicole.

Nicole said the most difficult part was breaking the news to Misty’s four children, ranging from 12 years old to six months old.

“She cared for everyone, loved everyone,” said Nicole. “She was a good person, a friend to everyone. No one expected anything like this to happen,” said Nicole.

The Coroner’s office says they don’t suspect foul play their death investigation. Her body will be taken to Frankfort for an autopsy on Friday morning.

Wrongful Death Testimony Reveals Details of What Led to Death of 14 Year Old

More details about the Thanksgiving Day shooting of a 14-year-old came out during a preliminary hearing for the suspect.

Kevin Garcia was in court as a detective testified about the events that led up to the shooting of 14-year-old Angel Juarez. Juarez was shot to death as he opened the door of his family’s home.

A Lexington detective said that Garcia had been looking for Juarez’s older brother.

Garcia told detectives that Juarez’s older brother had set up a robbery that had occurred at a nearby park.  Garcia and a man named Jose Ayala went to the Henton Road home later. They were told he wasn’t there. As they started to leave, 14-year-old Angel Juarez opened the door. That’s when witnesses say that Garcia opened fire, striking Juarez multiple times.

Garcia allegedly told Ayala to “not talk to police” and that he was fleeing the state and going to North Carolina.

Garcia was captured in West Virginia. When interviewed by detectives, police say that he confessed to opening fire and that he threw the weapon in the Kentucky River.

Juarez was a student at Leestown Middle.

Wrongful Death Man Pleads Not Guilty Shooting Death of Frankfort Woman

The man accused of gunning down and killing the mother of his child pleaded not guilty Thursday morning to a charge of murder.

Toma Washington is accused of shooting Jaleesa Robinson on Schenkel Lane Tuesday night. Robinson managed to drive to the Circle K nearby to call for help. She was taken to UK Hospital but later died of her injuries.

Washington has a lengthy criminal history including a conviction of manslaughter and a history of domestic violence. LEX 18 was unable to confirm if Robinson was the complainant in the previous domestic violence cases.

Family gathered last night to remember the beloved mother.

“Now we’ve got to raise the niece because the mom’s not here,” said Robinson’s sister Charmmisha Weathers. “We can’t even explain to my niece, her daughter, what happened. We’re hurt by the whole situation. It’s not right. It’s not right at all. It has to stop.”

Washington turned himself in to Frankfort Police.  He was arraigned via video conference. His bond was set at $500K full cash.

A preliminary hearing for Washington will be held next Tuesday.

Wrongful Death Suspect in Murder of Frankfort Woman Turns Himself In

Frankfort Police tell LEX 18 that the suspect in the shooting death of a woman has turned himself in.

Toma Washington was wanted in connection to the murder of Jaleesa Robinson Tuesday night. Police say Robinson called 911 and reported that she had been shot. She called dispatch from a gas station off Schenkel Lane just before 6 p.m. During a press conference, police told LEX 18 that she was shot at another location and drove for help.

Officers soon found her inside her SUV with several gunshot wounds and airlifted her to UK Hospital. She later died of her injuries.

Frankfort Police Chief Robert Warfel told LEX 18 that Washington is the father of one of Jaleesa’s children.

Several neighbors gathered near the Circle K while officers investigated and towed the victim’s car. Some expressed their surprise.

“As soon as I heard what happened, I was shocked,” said Davonte Jones.

“It’s never like this,” said David Muncie. “I don’t know what’s going on with Frankfort.”

Police have not given a motive for the shootings. According to court documents, Washington does have a lengthy criminal history including previous charges of manslaughter and domestic violence. Police could not confirm whether the domestic violence charges and an EPO were filed on behalf of Robinson against Washington.

Wrongful Death Man Who Distributed Drugs That Caused Overdose Death of Pregnant Woman Sentenced

A Lexington man who pleaded guilty to distributing fentanyl, which caused the overdose death of a pregnant Fayette County woman, has been sentenced to 30 years in federal prison.

On Tuesday, Fred Rebmann was sentenced to 360 months’ imprisonment for distributing a controlled substance that resulted in death.

Under federal law, Rebmann must serve at least 85 percent of his sentence. Rebmann told officials that he sold the pregnant woman a controlled substance that was believed to be heroin. Instead, the drug was fentanyl, a powerful opioid that can be as much as 50 times more potent than heroin.

She consumed the drugs and died. Toxicology reports confirmed that she had five times the therapeutic dose of fentanyl in her system and no traces of heroin or other controlled substances.

The report also concluded that, had it not been for the fentanyl, she would not have died.

“This case demonstrates why we use tough federal laws to prosecute drug dealers who sell poison that kills,” said Kerry B. Harvey, United States Attorney for the Eastern District of Kentucky. “For less than $100, the Defendant sold an obviously pregnant woman one of the deadliest drugs commonly available on our streets. The tragic result was all too predictable. Moreover, it is unacceptable, and we will use every prosecutorial tool available to us in order to protect our community from this predatory criminal conduct.”
