Fraud Investigation Lexington Man and His Medical Device Company Sued for Grant Fraud

The United States Government has sued a Lexington man, and the Lexington-based medical device company he owns, for violations of the False Claims Act, a federal law that prohibits people from submitting false or fraudulent claims for payment to the federal government.

On Tuesday, July 26, 2016, the United States filed a civil suit against Jerome Hahn and Telehealth Holdings, LLC, alleging that they defrauded the government by submitting false claims in connection with federal grants.  According to the Complaint, filed in U.S. District Court, Telehealth received three grants from the federal government, worth over $600,000, to support the development of a sleep apnea monitoring system and the development of electronic pillboxes customized for specific patient populations, including cancer patients.

The Complaint alleges that Hahn and Telehealth committed fraud in connection with these grants, including by making false statements in the grant applications about Telehealth’s personnel, facilities, and accounting systems.

The Complaint also alleges that Hahn and Telehealth falsely stated in grant reports that they had spent the grant funds for purposes of the grants and in compliance with grant regulations.  Instead, Hahn and Telehealth allegedly spent the grant money on personal expenses, such as meals at restaurants, a trip to Keeneland Racecourse, and interest payments on personal credit cards.  Hahn and Telehealth also allegedly used grant money on business expenses not allowed under the grant regulations, including costs associated with marketing and promoting their products.  Additionally, Hahn and Telehealth allegedly spent over $100,000 in grant funds purchasing foreign goods and services, even though grant regulations require grant recipients to use American goods and workers.

According to the Complaint, Telehealth also falsified entries in its accounting ledgers and created false invoices in order to conceal from the government that the federal grant funds had been misspent.

The Government contends that the false statements made in the grant applications, the grant reports, and the accounting ledgers constitute violations of the False Claims Act.  If the defendants are found liable at trial, they would be responsible for paying three times the amount of loss proven at trial, plus additional penalties for each false claim.

In a related criminal case, Mr. Hahn pleaded guilty to conspiring to defraud the United States by making false claims in connection with grants that were awarded to Telehealth.  On June 13, 2016, U.S. District Judge Danny C. Reeves sentenced Hahn to four months in prison and an additional six months on home detention.  Hahn was also ordered to pay $222,037 in restitution to the National Institutes of Health.

The investigation was conducted by the United States Attorney’s Office for the Eastern District of Kentucky; the Federal Bureau of Investigation; the U.S. Department of Health and Human Services, Office of Inspector General; and the Internal Revenue Service, Criminal Investigation Division.  Assistant U.S. Attorney Kate K. Smith represented the United States in the related criminal case.  Assistant United States Attorneys Christine Corndorf and Carrie B. Pond are litigating the False Claims Act case on behalf of the Government.

Pedophile Tracking Wake County, NC Man Arrested

A 20-year-old man has been arrested and charged with raping an 11-year-old girl, Wake County arrest records show.

Jahmal Wilson, 20, of Youngwood Road in Fuquay-Varina, has been charged with one felony count of rape of a child, one felony count of first-degree sex offense with a child, and one count of misdemeanor resisting a public officer for offenses that date back to October 2015 and June of this year..

According to Wake County arrest records, Wilson is accused of having sex with an 11-year-old girl in October and November 2015 when he was 19 years old.

The resisting a public officer charge stems from an incident on June 1 when Wilson is accused of running from a Fuquay-Varina police officer who was attempting to serve the two felony child sex charge arrest warrants.

Wilson was arrested Sunday morning in the 500 block of Marble Street in Raleigh, records show.

He is being held in the Wake County Detention Center under a combined secured bond of $2,501,000

Wrongful Death Woman Charged in Fatal Crash Had Just Finished DUI Classes

The Lexington woman accused of striking and killing a Louisville police officer and a UK employee had just finished a month of court-ordered DUI classes.

Court officials confirm that Suzanne Whitlow was issued a certificate for completing classes for a 2014 DUI. She finished the classes on October 6.

Her driver’s license had been suspended for 45 days and she was fined $700.

Whitlow has been charged with two counts of manslaughter and one count of driving under the influence.  She is accused of striking and killing Louisville Metro Detective Jason Schweitzer and University of Kentucky employee Timothy Moore.

A family member told LEX 18 that they are still trying to figure out what is happening in Whitlow’s legal case. At this point all they would say was that this is a tragic situation and their hearts go our the victims’ families.

Det. Schweitzer’s wife is expecting their second child.

Wrongful Death Russell County Man Facing Murder Charge in Beating Death

A Russell County man was found dead in his home Saturday morning and a second man is now behind bars charged with murder.

State police say 70-year-old Douglas Carnes was found dead in his Jamestown home around 8 Saturday morning. Troopers say it appears he was involved in some sort of fight, and he was beaten to death.

53-year-old Rick McWhorter is charged with murder and is currently in the Russell County Detention Center.

Wrongful Death Powell County Man Shot and Killed While In Car

State police in Powell County are investigating after a man was shot and killed in his car on Mountain Springs Road. The Powell County coroner has identified the victim as 53-year-old David Rogers.

Investigators say Rogers was in his vehicle when the bullet went though the windshield of his car and struck him in the face.

It’s unclear when Rogers was shot, but he was discovered around 4 p.m. Sunday. He was pronounced dead on the scene.

Wrongful Death Clark County Man Indicted in Fatal Crash

A Clark County man has been indicted in a fiery crash that killed two women last June.

James Pelfrey, 84,  was arrested Thursday for his role in the crash that resulted in the deaths Sarah Helfrich and Juanetta Mitchell.

Pelfrey told police he was blinded by headlights and didn’t see the women’s car stopped in front of him. Pelfrey crashed into the car killing the two women.

A lawsuit was filed against Pelfrey by Helfrich’s husband, claiming that he acted “wantonly and negligently.”

From jail, Pelfrey told LEX 18’s Kelsey Borza that he simply didn’t see the car and calls the crash “a terrible accident.”

“I pray every night for the family and I’m sorry it happened, but I just didn’t know. I couldn’t see… couldn’t see nothing after he blinded me,” he said.

Pelfrey was indicted by a Clark County grand jury on two counts of manslaughter and one count of assault for injury to another passenger in the vehicle.

Helen Kilby contacted LEX 18 to say that she and her sister were injured in the crash involving Pelfrey. Kilby told LEX 18 that they were in the first car stopped at the red light. She claims Pelfrey’s car hit Helfrich’s car, then Helfrich’s car hit her car.

Missing Person 23 Year Old CA Woman, Last Seen at Antioch Bus Station

A 23-year-old woman has been reported missing after last being seen at a bus station in Antioch on Monday, according to Pleasant Hill police.

Dominique Lockett was dropped off at the bus station on Monday and was scheduled to work at a retail store in Pleasant Hill later that evening, but never showed up, police said.

Lockett was last seen wearing a black shirt and brown pants and might be in the Oakland area, police said.

She is considered a voluntary missing person as of today. No other details about the case were immediately available.

A former Louisville teacher was sentenced to 10 years in prison for sexually abusing a student nearly 30 years ago.

Philip Dale Anderson was found guilty last month on sodomy and sex abuse charges.
