Wrongful Death Missing Montana Toddler Found Dead, Person in Custody

A 13-month-old girl who was abducted from her home in Poplar on Tuesday night has been found dead.

Lee Allmer, Roosevelt County public information officer, said authorities found Kenzley Olson dead in Poplar on the Fort Peck Indian Reservation on Wednesday.

One person is in custody in connection with the death and officials from the Roosevelt County Sheriff’s Office and the Federal Bureau of Investigation, which is in charge of the investigation, were questioning the detained person. The name of the person in custody was not released.

Law enforcement officers were searching for additional people on Wednesday in connection with the death, said Roosevelt County spokesman Lee Allmer.

“There may be others that are detained at some point,” he said. “No charges have been brought to my knowledge.”

A cause of death had not been determined. No further details were available.

The Montana Department of Justice canceled an Amber Alert issued early Wednesday for the girl.

Authorities said they’ve ruled out two persons of interest from North Dakota earlier named in the Amber Alert as people who have taken the girl from her Poplar home.

The Amber Alert was issued Wednesday morning, reporting that the girl was taken at about 9 a.m. on Tuesday.

The initial alert said the North Dakota man and woman may have been headed to Minot, N.D., in a silver 2006 Chrysler 300C.

The woman, Melinda Tweet, 51,  and the Chrysler were located in Minot on Wednesday and the people were ruled out as suspects. Police also said that Tweet and a man could not have been involved as they were accounted for on Tuesday.  However, Minot police said late Tuesday afternoon that Tweet and her son, Tyler Moulton, 25, were arrested on firearm and drug charges after police made contact with her in regard to the case about 7:45 a.m. Wednesday.

Police said Tweet and her son were acquaintances of the abducted child’s mother.

Tweet was charged with felon in possession of a firearm, possession of methamphetamine, two counts of drug paraphernalia possession and ingestion of meth. Moulton was arrested on charges of possession of meth and possession of drug paraphernalia.

The two were taken to the Ward County jail.

Poplar is a town of about 850 people on U.S. Highway 2 in northeastern Montana, on the edge of the reservation which is home to about 10,000 people.

Olson’s death followed the Feb. 26 abduction of a 4-year-old girl from a public park in Wolf Point, a town about 20 miles west of Poplar also in Roosevelt County. An Amber Alert also was issued in that incident.

The girl was found alive on Feb. 28, and John William Lieba has been charged in Fort Peck Tribal Court in the incident.

Lieba, 20, pleaded not guilty on March 1 to charges of kidnapping, attempted murder and aggravated sexual assault of a minor.

Judge Marvin Youpee ordered him held without bail.

Anyone with information regarding Olson’s disappearance can call 911 or contact the Roosevelt County Sheriff’s Office at (406) 653-6240.

Private Detective: OH Woman Leads Police on Multi-County Chase

An Ohio woman led police on a multi-county high-speed chase in central Kentucky, Thursday afternoon, until a deputy put an end to her run.

Sgt. Keith Broughton, with the Woodford County Sheriff’s Office, said after observing Stephanie Burchett, 33, drive recklessly for several miles they had no other choice but to run her off the road, “that just consists of using the right front of my  bumper to tap the left rear bumper of her car and put into a spin.”

He also said Burchett continued to drive erratically despite being chased and put many others in danger, “speeds exceeding 100 mph and began to intentionally drive her vehicle in oncoming traffic lanes.”

http://liarcatchers.com/contact.php

Sgt. Broughton said the chase started around 1 p.m. when Versailles Police saw Burchett  heading west on US 60, then onto the Bluegrass Parkway.

An officer tried pulling her over but she took off.

Deputies say she went about 20 miles all the way to Lawrenceburg driving recklessly along the way, “running traffic lights, lane changes, forcing vehicles out of their lanes, running stop lights.”

Sgt. Broughton said Burchett drove through some neighborhoods and tried to drive back toward Versailles when he put an end to it.

He says for being out-of-state, Burchett knew her away around very well, “it would appear that she was driving as if she had some familiarity with the area although I do not what her tie to central Kentucky is.”

Burchett suffered minor injuries.

She was taken to the Woodford County Jail when she left the hospital. She’s facing several charges including DUI, wanton and endangerment, reckless driving, possession of marijuana, fleeing or evading police and several more.

Wrongful Death 3 Face Capital Murder Charges in Death of Missing El Paso Man

Three people face a capital murder charge in the death of a 19-year-old El Paso man reported missing earlier this month.

Police said the body of Tristan Lee Mina was found in desert area 10 miles off of Interstate 10 in Hudspeth County on Friday.

Mina was reported missing on April 9 after he was last seen leaving his residence around 2 a.m. Just before 9 a.m. that same day, police were dispatched to 500 Buena Suerte Drive when a person found several items belonging to Mina.

http://liarcatchers.com/wrongful_death.html

Police went to Mina’s residence and his workplace for a welfare check, but he was not found.

Samuel Rico, 20; Jose Guadalupe Andrade, 25; and Jesse Adrian Martinez, 19, were arrested and face capital murder charges.

According to police records, the three suspects were planning to rob Mina during a drug deal. Rico, Andrade and Martinez were going to buy cocaine from Mina.

Police detectives said Martinez and Rico told them that Andrade beat Mina to death with a baseball bat, striking Mina in the back of the head. The report states Rico said Andrade continued beating Mina on the ground, hitting him four to five times.

They also told investigators that Mina’s body was put inside the trunk of the car and taken to the desert. According to the report, Rico admitted to helping Andrade place Mina’s body in the trunk

The report states Martinez was then dropped off at his residence and then Rico and Andrade drove to the location 10 miles off of I-10 near the Fabens exit. In the report, Rico told detectives Mina’s body was set on fire and buried there.

The report states Martinez and Rico admitted to putting their clothes in a box along with Andrade’s clothing in a desert near west El Paso. The report states the trio then set the box on fire with the clothes they were wearing when they met Mina.

According to the report, there was a fourth person involved with the case who was also interviewed by investigators. According to the report, the fourth person helped the three suspects get rid of evidence, and provided gloves to Andrade. The report also states the fourth person witnessed the suspects burning evidence. Police said this fourth person has not been arrested.

Booking photos for the three men were not released as police said they continue their investigation.

The El Paso Police Department’s Crimes Against Persons Unit and the FBI are investigating the case.

Pedophile Tracking Man Fakes Disappearance to Escape Child-Porn Charges

When Cody Magee’s wife reported that her husband hadn’t returned from a kayaking trip off the Georgia coast, the Coast Guard launched a two-day search by land and sea.

Magee was eventually found alive — in Oklahoma. Authorities say he staged his disappearance to escape prosecution on charges that he sought sex with a child.

Magee, 38, of Savannah was being held Wednesday in Oklahoma City after failing to appear in court Monday on charges of child pornography and attempted child molestation in Effingham County west of Savannah, said Savannah-Chatham County police spokesman Sonny Cohrs.

http://liarcatchers.com/pedophile_tracking.html

Sheriff’s deputies arrested Magee last June after undercover investigators posing online as a young teenager lured him to a home, said Sgt. Don White of the Effingham County Sheriff’s Office.

“He was chatting with what he thought was a 14-year-old girl,” White said. “He wanted to act out some rape fantasies with her.”

Magee shared images of child pornography during the online exchanges with undercover investigators, White said. During the arrest, he said, deputies found a handgun in Magee’s pocket.

Stuart Patray, identified by the public defender’s office for the Ogeechee Judicial Circuit as Magee’s lawyer, didn’t return a phone call Wednesday.

It wasn’t known if he would face additional charges for faking his disappearance, said Cohrs, who said Magee’s wife first reported him missing.

“He was supposedly going kayaking and was supposed to be gone for an hour,” Cohrs said. “He never came back.”

The Coast Guard launched a two-day search for Magee around Tybee Island, a beach community 18 miles east of Savannah, said Petty Officer 2nd Class Anthony Soto. Crews covered more than 2,500 square miles before the search was called off Tuesday night, Soto said.

A few hours before midnight Tuesday, a police officer in Oklahoma City pulled Magee over after a routine license plate check showed he had been reported missing, said Oklahoma City police Sgt. Gary Knight. Police found a handgun and rifle in his car, Knight said.

Magee talked with the officer and was taken to a hospital, Knight said, though he declined to say why. Savannah police said in a news release that Magee was “considered a danger to himself.”

Georgia authorities were working to extradite Magee.

Fraud Investigation Hazard Doctor, his Wife and the Clinic Convicted in Massive Scheme

A federal jury in London has convicted a doctor, his wife and their clinic of drug trafficking, health care fraud and money laundering, for orchestrating a scheme in which they made millions of dollars by unlawfully prescribing large amounts of prescription pills to citizens of eastern Kentucky.

Dr. James “Ace” Chaney, 51, was convicted of conspiracy to commit drug trafficking, 62 counts of illegal distribution of controlled substances, 2 counts of maintaining a premise for drug distribution, conspiracy to commit money laundering, 20 counts of money laundering, conspiracy to commit health care fraud and 84 counts of health care fraud.

http://liarcatchers.com/fraud_investigation.html

Lesa Chaney, 50, the President and CEO of Ace Clinique of Medicine, LLC, was convicted of conspiracy to commit drug trafficking, 2 counts of maintaining a premise for drug distribution, conspiracy to commit money laundering, 20 counts of money laundering, conspiracy to commit health care fraud and 84 counts of health care fraud.

Ace Clinique of Medicine, LLC, was found guilty on over 180 counts of drug trafficking, health care fraud and money laundering.

The jury rendered its verdict after 13 hours of deliberation, following seven weeks of trial.

From 2006 to 2014, James and Lesa Chaney owned and operated Ace Clinique of Medicine, LLC, in Hazard, Ky. The evidence established that Dr. Chaney pre-signed prescriptions for controlled substances, to be filled out by clinic staff while he was vacationing or otherwise not present at the clinic. The evidence also established that Dr. Chaney knowingly provided prescriptions for controlled substances to individuals who were diverting the pills for sale and to individuals that were abusing the drugs. Dr. Chaney also required all of his patients to undergo monthly urine drug screening to test for the presence of the drugs he prescribed, as well as illegal narcotics. When the results showed the patients were not taking the prescribed pills, or were taking illegal narcotics, Dr. Chaney directed his staff to alter the test results to falsely indicate an appropriate result. These fraudulent test results were then submitted to Medicare, Medicaid and private insurers for payment. From 2009 to 2011, they billed Medicare for more urine drug screen tests than any provider or laboratory in Kentucky.

The evidence at trial also showed that patients would frequently wait eight hours or longer, each month, to be seen by a health care provider at the clinic. The examinations would then typically be of short duration and the patient would receive a prescription for controlled substances. The Chaneys would nonetheless bill for an office visit that falsely indicated a thorough physical examination had occurred. The evidence further showed that the Chaneys billed Medicare for work Dr. Chaney allegedly did while he was vacationing outside of the United States. Dr. Chaney also wrote prescriptions for controlled substances to an employee of the clinic, which he then took for himself.

The Chaneys billed Medicare more than $9,500,000 and billed Medicaid more than $6,300,000 during the period of the conspiracy. The money the Chaney’s made from the scheme was used for personal purchases, including a private plane, houses, vehicles, travel and personal luxury items.

“The defendants in this case combined a massive illegal drug distribution scheme with a massive healthcare fraud scheme,” said Kerry B. Harvey, U.S. Attorney for the Eastern District of Kentucky. “The resulting criminal enterprise harmed countless Kentuckians, and sent the fraudulent bill to the American taxpayer. It is difficult to overestimate the importance of this victory in the effort to rid eastern Kentucky of this sort of criminal conduct, which has caused so much damage to our communities. Our trial team and our law enforcement partners at the FBI and the Kentucky State Police performed admirably in bringing these defendants to justice and they deserve our thanks.”

“The devastation of patients’ lives to facilitate the Chaney’s’ lavish lifestyle caused great harm to the people of southeastern Kentucky,” said Howard S. Marshall, Special Agent in Charge of the Louisville Division of the FBI. “The Federal Bureau of Investigation and its law enforcement partners will stay committed to the dismantlement of significant drug trafficking organizations in Perry County and the rest of Kentucky.”

U.S. Attorney Harvey, Special Agent in Charge Marshall and Richard Sanders, Commissioner of the Kentucky State Police, jointly announced the verdict.

The investigation was conducted by the FBI and the Kentucky State Police.

Assistant U.S. Attorneys Roger West and Andrew Sparks prosecuted this case on behalf of the federal government.

The Chaneys are scheduled for sentencing on August 25, 2016, at 1:30 p.m. The most serious offenses carry a maximum penalty of 20 years in prison. The Court, however, will impose sentence after consideration of the U.S. Sentencing Guidelines and the applicable federal statutes.
