Private Detective: Louisville Daycare Investigated After Child Dies in Hot Car

A child care center is at the center of an investigation after a child was found dead in an SUV outside of a Louisville elementary school.

Officers tell WAVE 3 News that 2-year-old Lavonte Swain was left in an SUV belonging to Lil Kings and Queens Daycare. It was an employee of the child care center who was driving the SUV in which Swain died of heat stroke on Monday.

While police won’t release additional information about the employee at this time, WAVE 3 News found a long list of violations at Lil Kings and Queens three locations including investigations into tracking how long children were left in the vans.

http://liarcatchers.com/contact.php

The daycare was found to not be in compliance because staff did not document the arrival time of four children, falsifying records and compromising the welfare of children. Complaints included leaving children unattended, leaving their food out for hours and making children sit in a circle for long periods of time without any activities, among other violations.

WAVE 3 News reports that an emergency license suspension has been issued by the Kentucky Office of Inspector General for the child care facility. The memo issued to parents and guardians of children at the facility stated, “The Emergency Suspension was issued to protect the health, safety and welfare of children in care. The center is required to surrender the license to operate and remain closed until further notice.”

The Kentucky Office Of Inspector General says that after an investigation, they have determined that an employee at Lil Kings and Queens picked up Lavonte from his home at 9:36 a.m. on April 18th, and, according to evidence, failed to deliver him to the facility as planned. Staff interviews revealed that Lavonte was not present at the center at any time on April 18th. The emergency license suspension states that the same employee who picked up Lavonte drove to a Louisville Elementary school to pick up more children. It was there that Lavonte was discovered in the backseat of the SUV by two school age children at around 3:45 p.m.. He was pronounced dead after being brought into the school for emergency resuscitation.

“Our thoughts and prayers are with the little boy’s family and all the children and families impacted by this tragedy,” said the Cabinet for Heath and Family Services (CHFS) Cabinet Secretary Vickie Yates Brown Glisson. “Ensuring the safety and wellbeing of Kentucky’s most vulnerable citizens is our highest priority and we will not hesitate to take action against facilities that place children in harm’s way.”

CHFS staff members are working to find new day care services for the families of the children who attended the daycare and they are offering counseling services for the children who attended Lil Kings and Queens.

The name of the daycare employee who was driving the child has not been released.  No charges have been filed.

Private Detective: Former Secretary of KY’s Personnel Cabinet Pleads Guilty to Accepting Kickbacks

Timothy M. Longmeyer, the former Secretary of the Kentucky Personnel Cabinet, admitted in federal court today that he solicited and accepted over $200,000 in kickbacks from a private consultant during his tenure.

Longmeyer, 48, pleaded guilty to bribery of a public official, before U.S. District Judge Karen Caldwell.

Longmeyer admitted that, while serving as Secretary of the Personnel Cabinet, he solicited and agreed to accept $212,500, in exchange for assistance in securing multi-million dollar contracts for a consultant. Over the course of the scheme, Longmeyer received $197,500 in cash and $6,000 in straw campaign contributions to various political campaigns, for a total of $203,500.

http://liarcatchers.com/contact.php

Longmeyer oversaw the Kentucky Employees’ Health Plan (“KEHP”) and used his position to persuade insurance companies, who provided KEHP healthcare coverage, to hire the consultant to organize focus groups and telephone surveys. In return, Longmeyer accepted recurring payments from the consultant, including cash and straw contributions.

According to the plea agreement, Longmeyer agreed to accept $90,000 from the consultant in November 2014 and $100,000 from the consultant in December 2014. The consultant later used the proceeds from contracts with Humana, Inc., to make a series of payments to Longmeyer between November 2014 and June 2015, totaling $175,000 in cash and $6,000.00 in straw contributions.

In addition, in September 2015, Longmeyer agreed to accept approximately $22,500 from the consultant. The consultant used the proceeds from a contract with Anthem Blue Cross Blue Shield to make two cash payments to Longmeyer, totaling $22,500.

Kerry B. Harvey, United States Attorney for the Eastern District of Kentucky, and Howard Marshall, Special Agent in Charge, Federal Bureau of Investigation, jointly announced the guilty plea. Assistant U.S. Attorneys Andrew T. Boone and Kathryn M. Anderson are prosecuting the case on behalf of the federal government.

Longmeyer is scheduled to be sentenced on August 18, 2016 at 1:00 p.m. He faces up to 10 years in prison and a maximum fine of $250,000. However, any sentence following a conviction would be imposed by the Court after consideration of the U.S. Sentencing Guidelines and the applicable federal statutes.

Private Detective: Former President of Auto Parts Company Pleads Guilty in Conspiracy

The former president of an automotive parts company pleaded guilty today and was sentenced to serve 18 months in a U.S. prison for his role in a conspiracy to fix prices and rig bids for the sale of automotive body sealing products sold in the United States, the Justice Department announced.

Keiji Kyomoto, a former executive of an automotive body sealing products supplier based in Hiroshima, Japan, and former president of its U.S. joint venture, pleaded guilty today in the U.S. District Court for the Eastern District of Kentucky to a single-count indictment charging him with bid rigging and price fixing.  As part of his plea agreement, Kyomoto also agreed to pay a $20,000 criminal fine.

“Today’s plea is yet another example of our commitment to holding senior-level executives accountable for corporate wrongdoing,” said Deputy Assistant Attorney General Brent Snyder of the Justice Department’s Antitrust Division.  “Whether collusion has affected automobile parts, shipping services, financial products, electronic components or even heir location services, the department has a strong and ever increasing record of prosecuting individuals in order to deter criminal antitrust practices.”

http://liarcatchers.com/contact.php

“The FBI is committed to aggressively investigating individuals who engage in criminal conduct that corrupts the global marketplace,” said Special Agent in Charge Howard S. Marshall of the FBI’s Louisville Division.  “We will continue our work with the Department of Justice Antitrust Division to uncover schemes aimed at creating an unfair competitive advantage by way of price fixing, bid rigging or other illegal means.”

On Oct. 8, 2015, a federal grand jury in Covington, Kentucky, returned an indictment against Kyomoto and two other individuals, charging them with conspiring to rig bids for and fix the prices of body sealing products sold to Honda Motor Company Ltd., Toyota Motor Corp. and certain of their subsidiaries and affiliates for installation in vehicles manufactured and sold in the United States and elsewhere.  Automotive body sealing products consist of body-side opening seals, door-side weather-stripping, glass-run channels, trunk lids and other smaller seals, which are installed into automobiles to keep the interior dry from rain and free from wind and exterior noises.

According to the indictment, Kyomoto and his co-conspirators instructed subordinates at their respective companies to communicate with co-conspirators at other companies in order to allocate sales of, rig bids for and fix the prices of automotive body sealing products; were aware that employees under their supervision were engaging in such communications; and condoned such communications.  The indictment further alleged that Kyomoto attended meetings in the United States with co-conspirators during which Kyomoto and the co-conspirators reached agreements regarding sales of automotive body sealing products to Honda and Toyota.  The indictment charged Kyomoto with participating in the conspiracy beginning at least as early as September 2003 until at least October 2011.  For most of this period, Kyomoto resided in the United States and served as president of an unnamed joint venture with offices in Indiana and Michigan, which manufactured and sold automotive body sealing products.

Today’s guilty plea is the result of an ongoing federal antitrust investigation into price fixing, bid rigging and other anti-competitive conduct in the automotive parts industry, which is being conducted by the Antitrust Division’s criminal enforcement sections and the FBI.  A total of 58 individuals and 39 companies have been charged and have agreed to pay more than $2.6 billion in criminal fines.  This case was brought by the Antitrust Division’s Chicago Office and the FBI’s Louisville Division, Covington Resident Agency, with the assistance of the FBI’s International Corruption Unit and the U.S. Attorney’s Office of the Eastern District of Kentucky.  Anyone with information about anticompetitive conduct in the automotive parts industry should contact the Antitrust Division’s Citizen Complaint Center at 888-647-3258 FREE, visit www.justice.gov/atr/contact/newcase.html or call the FBI’s Louisville Division at 502-263-6000.
