Wrongful Death Suspect in Murder of Lexington Teen Back in Court

The suspect in the murder of a Lexington teen has had his case waived to a grand jury.

Marquess Smith was taken into custody by Lexington Police earlier this month. He was wanted in connection with the death of 18-year-old Caleb Hallett after what police are calling a robbery gone wrong.

Police say two men wearing masks fired shots hitting two people. Hallett didn’t survive.

A suspect who was a juvenile at the time of the incident was also arrested at the same time as Smith. He is identified as Marique Quintay Sturgis. He turned 18 at the end of February. Sturgis is accused of shooting the surviving victim. He also appeared in court Thursday on an unrelated trafficking case.

Another suspect in the case, Kenyon Hipps, committed suicide after being stopped by police in Ohio.  Two other juveniles were also arrested in connection to the case.

Smith is charged with murder, first degree assault and two counts of first degree robbery. He pleaded not guilty to all of the charges in this case and not guilty to giving a false name in a separate case. The grand jury has 60 days to indict Smith. Smith is due back in court next Thursday for a misdemeanor charge.

Neither Smith nor Sturgis have been granted bond.

Insurance Fraud Boise Insurance Agent Sent To Prison

For four years, Mylinh N. Fetterman issued insurance policies under clients’ names without their knowledge and took money from their bank accounts.

As a result, Fetterman, 40, received commissions that she hadn’t earned and the clients paid for policies they didn’t want.

Ada County District Judge Steven Hippler sentenced Fetterman on Tuesday to one to six years in prison. The judge also ordered her to pay $31,090 in restitution to her former employer, Primerica Insurance.

http://liarcatchers.com/insurance_fraud.html

Fetterman pleaded guilty in January to one count of insurance fraud. Three other counts were dismissed in exchange for her guilty plea.

Authorities became aware of the theft after Primerica conducted its own investigation and notified the Idaho Department of Insurance. The company fired Fetterman following its investigation.

The case was prosecuted by deputy attorneys general from the Insurance Crimes Unit.

Fetterman pleaded guilty last month in a second case, where she was charged with grand theft. She is scheduled to be sentenced in that case on March 25.

Since 2014, three default judgements totaling $3,069 have been entered against Fetterman in cases brought by loan companies.

Pedophile Tracking Kennewick, WA Sex Offender Sentenced to 10 Years

A Kennewick sex offender who tried to meet up with a 14-year-old girl for sex after a series of online chats is going to federal prison for 10 years.

While Thomas E. Lafontaine, 35, believed he was communicating with a young teen, but the girl actually was an undercover officer with Homeland Security Investigations.

Lafontaine was arrested after circling their meeting spot for 30 minutes and chastising the girl through his phone for standing him up.

http://liarcatchers.com/pedophile_tracking.html

At his sentencing in Richland’s U.S. District Court, Lafontaine said he was “disgusted and ashamed” of his actions, according to a news release from the U.S. Attorney’s Office for the Eastern District of Washington. He previously pleaded guilty to one count of attempted enticement of a minor.

Lafontaine responded to a personals ad in late 2014 and started chatting with the girl, graphically describing different sex acts he would like to perform, according to the news release.

The ad was placed by the undercover officer who was posing as the teen while working with the Southeast Regional Internet Crimes Against Children unit.

Lafontaine already was a registered sex offender.

Investigators later found evidence on Lafontaine’s electronic devices that he was talking to at least three other minors about sexual acts. Those real kids were ages 12 to 14, the release said.

Senior Judge Ed Shea said Lafontaine posed a “genuine threat to the public” because he went beyond the online discussions and actually got in his car intending to meet a child for sex, the release said.

Lafontaine’s prison term will be followed by 25 years on court supervision.

“This investigation is yet another demonstration of the dedication of law enforcement officers and their willingness to ferret out those who intend to victimize children,” said U.S. Attorney Michael C. Ormsby.

Pedophile Tracking Macon, GA Man Sentenced to 10 Years

A 37-year-old Macon man was sentenced to 10 years Wednesday — seven of them in prison — after he pleaded guilty to two counts of sexual battery on a minor.

Leroy Anthony Holmes II, of Columbus Drive, was indicted last year on rape and aggravated child molestation charges, according to Bibb County Superior Court records.

http://liarcatchers.com/pedophile_tracking.html

Prosecutor Nancy Scott Malcor said a 15-year-old girl reported in 2013 that Holmes had forced her to have sex and molested her for years, dating back to when she was about 7 years old.

The girl alleged that Holmes threatened to kill her and her family if she reported the sex acts, Malcor said.

Due to the delay in reporting the allegations, prosecutors had no physical evidence to present to jurors, spurring the offer for Holmes to plead guilty to the lesser felony charge.

Had the case gone to trial, prosecutors would have presented evidence that Holmes also molested a then-12-year-old boy when Holmes was 14, Malcor said.

Holmes’ attorney said she would have presented evidence disputing the allegation.

Holmes was sentenced as a first offender, meaning if he successfully completes his sentence, he won’t have a felony criminal record. If he violates terms of his sex offender probation or otherwise gets in trouble before he completes his sentence, he could be re-sentenced to additional time in prison.

Holmes has been held at the Bibb County jail since his Oct. 4, 2013, arrest.
